CALL TO ORDER: Mayor Delgado called the meeting to order at 6:00 pm.

AGENDA: CM Harris motioned to approve the agenda as amended. CM Wells seconded. The motion carried 4-0.
MINUTES: CM Wells motioned to approve the minutes for January 3, 2023, as corrected. CM Michaels seconded. The motion carried 4-0.
CONSIDERATION OF CLAIMS:  Mayor Delgado presented the vouchers for approval. CM Michaels motioned to approve the Considerations of Claims in the amount of $200,322.16, seconded by CM Harris. The motion carried 4-0. PUBLIC COMMENT:  The council heard comments regarding the council seat vacancy. Community members commenting were Nick Paustian, Christopher Martinez, Sarah Mosley, Troy Reichert, Cate Riley, Vicki Hood, Stacia Cook, Brad Cook, Robert Ibarra, Rose Martinez and Kellie Augustyn. Christopher Martinez also spoke against the Platte County Sheriff’s department providing law enforcement services for the Town of Guernsey. Robert Ibarra expressed frustration about the funding process to Tri-City Parks and Recreation for the 2022 pool season.
OATH OF OFFICE:  Mayor Delgado swore in appointees William Conner as Municipal Judge, Pam Hebbert as Clerk Treasurer, and Mike Fronapfel as Public Works Superintendent.
TRI-CITY PARKS AND RECREATION ADDITIONAL FUNDING REQUEST: Lori Ibarra presented on behalf of Tri-City Parks and Recreation. CM Michaels motioned that the Town of Guernsey reimburse Tri-City Parks and Recreation $11,016.60 to cover costs incurred to operate the pool for the 2022 season. CM Harris seconded. The motion carried 4-0.
RESOLUTION 2023-003/WMPA REPRESENTATIVE APPOINTMENT: CM Wells motioned to approve Resolution 2023-003 appointing Joe Michaels to serve a three-year term as a director to the Wyoming Municipal Power Agency from the Town of Guernsey. CM Harris seconded. The motion carried 3-0 with CM Michaels abstaining.
ZONING VARIANCE REQUESTS: CM Michaels motioned to approve variances for Kevin Lockman at 262 E. Whalen, and David L. and Wendy Robertson at 53 N. Dakota. CM Wells seconded. The motion carried 4-0. It was clarified that the Lockman approval is for the variance only. Construction approvals will be granted separately.
RAIL SPUR EXTENSION: A lengthy discussion was held about the proposed second rail spur, which included considerations for design, utilization and cost. The council will hold a workshop on January 31, 2023, at 5:00 pm, to discuss the matter further. CM Michaels motioned to table the item until after the workshop. CM Harris seconded. The motion carried.
COMMUNITY/ORGANIZATION REPORTS:  Shawna Reichert reported for the Platte County Chamber of Commerce and the Lodging Tax and Tourism Joint Powers Board. This year’s Chamber Ag Appreciation Banquet will be held February 11th and will be recognizing area ranchers. Christa Bartel provided information on behalf of Guernsey Economic Development about plans for the dog park. She also reported that Camp Guernsey is preparing for a busy summer training schedule.
DEPARTMENT REPORTS:  Jeff Thomas reported on training and call activity for the fire department. Justin Orr was named the department’s Firefighter of the Year. Derek Chavez reported the police department responded to 62 calls in the last two weeks and that providing full coverage with a reduced staff has been challenging. Mike Fronapfel has been working with electrical engineers on the Dollar General site. Public works staff is preparing for more snow. Chuck Porter provided an overview of his activity to include research for pedestrian signs and the permitting process for Dollar General. Joe Michaels reported for WMPA. The power stayed on through two bad storms – he extended thanks to the public works staff here. Basin is in a good position to provide reliable, reasonably priced power. He appreciates the opportunity to serve WMPA for another three years. Pam Hebbert reported that a workshop to meet with Lenhart-Mason will be scheduled when there is better opportunity to discuss the 2022 financial review. The pre-bid meeting for the Landfill Remediation Project will be held on February 1st at 1:00 pm.
MAYOR AND COUNCIL REPORT: CM Wells asked about the status of fire hydrant testing. Mayor Delgado asked Mike Fronapfel to put together a plan. CM Michaels inquired about C-130 and C-17 equipment at the airport. Mayor Delgado reported that the Platte County Commissioners initiated discussion about a plan for the Specific Purpose Excise Tax after the collection for current projects is complete. He asked citizens to submit to the Town ideas for any future projects as it would be important to choose the right one.
EXECUTIVE SESSION: At 7:32 pm CM Harris motioned that the council adjourn to an Executive Session for personnel. CM Michaels seconded. The motion carried 4-0.
RE-CONVENE REGULAR SESSION: At 8:47 pm the council re-convened to regular session. CM Michaels motioned to appoint Kellie Augustyn to the vacant council seat. CM Harris seconded. The motion carried 2-1, with CM Wells dissenting.
ADJOURNMENT: With no further business, CM Wells motioned that the meeting be adjourned, seconded by CM Harris. The motion carried 4-0. The meeting adjourned at 8:49 pm.
